GENERAL TERMS AND CONDITIONS
§ 1 Scope, customer information
The following general terms and conditions govern the contractual relationship between Bernhard Zimmermann and consumers who buy goods through our shop, Akkordeon Service Center. The language of the contract is German.
§ 2 Conclusion of contract
(1) The offers on the internet constitute a binding offer to you to buy goods.
(2) You can place one or more products in the shopping basket. During the ordering process you enter your details and your wishes regarding payment method, delivery arrangements and so on. Only when you click the order button do you accept the offer to conclude a purchase contract. You can also conclude the purchase contract by telephone.
§ 3 Customer information: storage of the contract text
Your order, with the details of the contract concluded (for example type of product, price etc.), is stored by us. We send you the terms and conditions, and you can also call them up at any time on our website after the contract has been concluded. As a registered customer you can access your past orders through the customer login area.
§ 4 Customer information: correcting your entries
You can correct your entries at any time before submitting the order using the delete key. We inform you of further ways to make corrections as you move through the ordering process. You can also end the ordering process completely at any time by closing the browser window.
§ 5 Liability for defects and shortening of the limitation period
(1) Liability for defects
Statutory rights in respect of defects apply to our goods.
(2) Shortening of the limitation period for used goods vis-à-vis consumers
It is agreed that the limitation period for claims in respect of defects in used goods is shortened to one year.
Excluded from this agreement are claims for damages, claims in respect of defects that we have fraudulently concealed, and claims under a guarantee that we may have given for the condition of the item. The statutory periods apply to these excluded claims. Where a guarantee period exists, the longer period applies in favour of the beneficiary of the guarantee.
§ 6 Limitation of liability
We exclude liability for slightly negligent breaches of duty, unless these concern material contractual obligations, damage arising from injury to life, body or health, guarantees, or claims under the German Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Material contractual obligations include in particular the obligation to hand the item over to you and to procure ownership of it for you. We are further obliged to provide the item to you free of defects in quality and title.
§ 7 Consumer information: participation in a dispute resolution procedure
We are willing to take part in a dispute resolution procedure before a recognised consumer arbitration body.
